Conditions of Use

Anyone accessing, visiting or using the Site, especially when sending electronic mail to any member of the Firm, whether acting on his/her own behalf or on behalf of a corporation (hereinafter a “User”), represents and guarantees having read these conditions of use and accepting the terms and conditions contained herein, without any restriction or reservation.

Each User must also regularly go through these conditions of use, the Firm reserving its right to update and/of amend them at any time without prior notice.

Purpose of the Site

The purpose of the Site is to provide general information on the Firm’s business. The Site should not in any manner be construed as an offer of services, soliciting an offer of services by the Firm or prospecting. The Firm does not guarantee the exhaustiveness, accuracy or topicality of any information contained in the Site. Any User wishing to check all or part of the information provided on the Site should directly enquire from any representative of the Firm.

Likewise, neither the Site nor any legal information it may contain should in any manner be considered as legal advice, a legal opinion or legal consulting provided by the Firm.

The Firm does not guarantee that the Site shall continuously be available. Any User is hereby advised of the fact that the Firm reserves its right to amend, suspend and/or delete all or part of the Site and the information it contains, at any time and without prior notice.

The Firm cannot therefore be held liable for any alleged or confirmed damage, directly or indirectly suffered by any User due to its being connected to the Site, consulting and/or using any information providing on the Site.

Protection of personal data

Users whose personal data, such as e-mail address, name and details, is collected, or who disclose personal data to the Firm via the Site, are hereby advised that, in compliance with the Loi informatique et libertés (freedom and data protection act) of 6 January 1978, as subsequently amended, they are entitled to an access, rectification and opposition right that they may exercise with the Firm by sending an e-mail to cabinet@uggc.com or a letter to the following address: UGGC & Associés, Département communication, 47 rue de Monceau – 75008 Paris.

In this respect, any User may obtain communication of the information provided for under the Loi informatique et libertés.

Personal data is processed by the Firm, on its own behalf and on behalf of any subsidiary it controls, according to French Commercial Code Article L.233-3 (hereinafter a “Subsidiary”).

Personal data is only kept and used for the sole purpose of replying to e-mails sent to the Firm and its members. They may be kept and stored by the Firm for any length of time it sees fit to process such replies, although not exceeding in any event the holding period provided for under applicable regulations.

Users are advised that the Site uses cookies, intended to store browsing information during Site viewing. A cookie may not be used to identify a User but it records browsing information about the computer on the Site (pages viewed, viewing date and time, etc.) that may be read during subsequent visits. Users may deny access by cookies by configuring their browser’s settings in accordance with the documents provided with their software.

Users’ IP addresses are kept by the Firm for the sole purpose of checking any potential Site malfunctions, ensuring its security and maintenance and work out unidentified statistics.

Users are advised that their personal data may be disclosed to any Subsidiary, including Subsidiaries located in a country not belonging to the European Community. They may not however be disclosed, transferred or hired to any third party.

Users are also advised that disclosure of personal data is not mandatory to access and/or view the Site. The only mandatory disclosure is a valid e-mail address when sending an e-mail to the Firm or one of its members, so that a message may be sent if applicable to reply to this e-mail.

Personal data concerning Firm members accessible on the Site may not be collected and processed with the prior written consent of the person in question. In particular, each and every User shall refrain to collect and use such personal data, either by manual or automated means, to send advertising or other messages whatsoever that are not related to the Firm’s business or that of its members.

Intellectual Property

The Site and anything in it, such as texts, articles, information letters, press releases, presentations, reports, brochures, pictures, photographs, computer programs, animations, etc., are exclusive intellectual property of the Firm or third parties, such as for instance third party trademarks that may be mentioned on the Site.

All intellectual property rights attached to the photographs reproduced on the Site have been assigned to the Firm.

Data bases used on the Site belong to the Firm or to third parties, and their content is protected by the rights pertaining to data base producers.

Users are only allowed to display the Site on the screen of their personal computers and to temporarily reproduce the files making it up in the cache memory of this computer for the sole purpose of ensuring easier access and/or viewing of the Site.

In particular and subject to the stipulations of the above paragraph, Users are not allowed to reproduce, represent, modify, translate and/or adapt all or part of the Site and any information it contains, for a fee or free of charge, and to reproduce and/or represent any such translations, adaptations and modifications, in all or in part, for a fee or free of charge, without the prior written consent of the Firm.

As an exception to the above paragraphs, the Firm allows Users to download on the hard disk of their personal computer, information letters or other documents, belonging to the Firm, made available to Users as electronic files specifically intended for downloading.

In this event, unless expressly stipulated otherwise on each of the above mentioned documents, Users shall only be allowed to hold one copy of these documents and print them for a strictly private use. Users shall in particular refrain from distributing such documents to third parties, including via e-mail, by printing them and distributing them in hard copy and making them available on a server installed in a public or private network.

Links

Users are not allowed to create hypertext links to the Site and/or any page of the Site and/or any file on it without the prior written consent of the Firm.

The Firm shall not in any event be held liable for any such existing hypertext link between its Site and third party sites and/or for the content of such sites that the Firm does not condone in any manner.
