BRDA – Labour market: beware of anti-competitive agreements between employers with Corinne Khayat and Pierre-Yves Laurioz
Non-bid-rigging agreements, which exist in particular between companies active in the consulting and technology sectors, are liable to result in heavy fines for anti-competitive agreements. Corinne Khayat and Pierre-Yves Laurioz take stock of the decision-making practice of competition authorities, and make a number of recommendations.
In a press release issued on November 23, 2023, the General Rapporteur of the French Competition Authority (Autorité de la Concurrence) announced that he had notified several companies in the engineering, technology consulting and IT services sectors of their complaints concerning labor market cartels. They are accused of having concluded and implemented “no-hiring” agreements, aimed at prohibiting each other from soliciting and hiring their respective staff.
This press release comes a few weeks after Olivier Guersent, the European Commission’s Director General for Competition, indicated that “the Commission has started to take an interest in practices that were not previously on its radar, such as no-solicitation agreements”.
