Fees for regulated station services: ART rejects the Nouvelle-Aquitaine Region’s requests

UGGC Avocats assisted SNCF Gares & Connexions in a dispute resolution procedure (RDD) before the French Transport Regulation Authority (ART), concerning the fees applicable to regulated station services.

The Région Nouvelle-Aquitaine asked the ART to order SNCF Gares & Connexions to retroactively modify the 2020 station reference document (DRG) in order to introduce :

– differentiated allocation of investment costs for the calculation of the fee, in particular according to the actual use of the platforms;

– the addition of new criteria for modulating charges (notably according to train length, carrying capacity, platform accessibility, etc.).

In its decision no. 2025-084 of November 20, 2025, ART rejected these requests.

– On the allocation of investment costs: ART confirms that the pricing method complies with the principles set out in article 13-1 of decree no. 2003-194 of March 7, 2003, which notably provides for allocation by “management perimeter”, and stresses that the Region’s request contradicts the objective of simplifying passenger rail station pricing.

– On the additional modulation criteria: the authority considers that SNCF Gares & Connexions was not obliged to implement such a modulation of fees, and that the Region’s concerns are already taken into account via the existing modulation coefficients.

The Nouvelle-Aquitaine Region’s requests are therefore rejected. The team that accompanied SNCF Gares & Connexions included Philippe Hansen, Mehdi Bekkali and Elliot Eloire.
