Our teams have developed a strong expertise in collective disputes pleaded before the courts, whether related to the consultation powers of the CSE (quality of information transmitted, recourse to expertise, deadlines, procedure followed, prerogatives of the CSE and internal regulations) or disputes against trade union organizations (application of collective agreements, professional elections, etc.).
A solid defense
As an extension of our consultancy work, we defend administrative decisions taken in relation to PSE and challenge refusals to authorize the dismissal of protected employees before the administrative courts.
Before industrial tribunals, UGGC avocats defends individual cases (contested dismissals, challenges to lump-sum payment schemes, moral harassment, discrimination, wage adjustments, employer’s inexcusable fault, etc.), including their consequences in social security matters before the social division of the judicial courts (industrial accidents and recognition of occupational illnesses, challenges to IPP rates, etc.). We also handle challenges to URSSAF reassessments.
Lastly, the development of criminal sanctions is leading us to defend our clients more and more regularly in these areas, particularly in relation to breaches of working time regulations, or obstruction of the rights of employee representatives.
